Public Records Act – Guide to Exemptions

 

The Public Records Act provides that certain types of records and information are exempt from disclosure.

 

Requestors should also be aware of the following provisions outside of the Public Records Act that may exempt some records and information held by DOP:
  • RCW 41.06.160, RCW 41.06.167, and RCW 47.64.220 exempt certain information provided by private employers for state employee salary surveys.
  • RCW 41.06.450 allows an agency to destroy certain information relating to employee misconduct or alleged misconduct. This provision is specifically recognized in the Public Records Act, RCW 42.56.110.

 

Where exempt information can be deleted from a record (redacted), the record will be provided without the exempt information. Whenever the Department withholds all or part of a record, we will identify the specific exemption that applies.
